This study analyzes the at-will employment doctrine using a tool that encompasses the complementarity of results-based utilitarian ethics, rule-based duty ethics, and virtue-based character ethics. The paper begins with a discussion of the importance of the problem followed by its evolution and current status. After describing the method of analysis, the central section evaluates the employment at-will doctrine, and is informed by Lord Acton's dictum, "power tends to corrupt, and absolute power corrupts absolutely." But the role of the Tao Te Ching in Chinese history and culture, as well as that of its purported author, is a much more complex affair. The text has been the subject of more than seven hundred commentaries and has been appropriated by vast networks of scholars, government officials, self-conscious religious communities, and laypeople, while Lao Tzu himself has undergone a fascinating history of deification and aesthetic representation. With Lao-tzu and the Tao-te-ching, editors Livia Kohn and Michael LaFargue take steps toward filling in some of the complicated (and much overlooked) post-canonical history by assembling essays on subjects ranging from the ritual uses of the text to modern hermeneutic experiments. The volume includes nine new essays, as well as three older ones reprinted or translated from earlier sources.The book is organized in four sections—"Ancient Myths," "Chinese Interpretations," "Modern Readings," and "Critical Methods"—although there is noticeable [End Page 625] overlap among the parts. The twelve essays are of varying quality and of varying use for different readers. Some of the material is highly technical and presupposes a sinological audience, while other material rehearses data that should already be familiar to scholars of ancient Chinese philosophy but may be tremendously useful to those who are interested in the text but lacking the scholarly background. One case of the latter is Julia Hardy's "Influential Western Interpretations of the Tao-te-ching," which does not especially break new ground but is a wonderful historical synopsis of Western scholarship on the text, as it meticulously identifies the key interpretive voices and sorts out their positions. Hardy gives only brief attention to the earliest eighteenth- and nineteenth-century scholarship—omitting, for example, any mention of Victor von Strauss' 1870 German rendition—which might actually have been most edifying for specialists. LaFargue and Julian Pas' "On Translating the Tao-te-ching" is essentially a primer on hermeneutic problems relevant to the text that serves as an intelligent corrective to the uncoordinated body of Taoist materials available to novice readers.What may be most clear from several of the essays taken in tandem is that the popular Western "mystical" reading of the text not only is one of many historical interpretations but is also very much heir to Wang Pi's intellectual lineage. In "A Tale of Two Commentaries: Ho-shang-kung and Wang Pi on the Lao-tzu," Alan K. L. Chan notes how such standard tenets as the spiritualized metaphysical understanding of Tao, the relationship between nonbeing and creativity, and the identification of naturalness and nonaction with spontaneity originate with Wang Pi but are nowhere to be found in the earlier Ho-shang-kung reading. The latter employs typical Han dynasty correlative cosmological interpretive methods, referring to naturalness as the preservation of energies in the physical body and to "the One" not as an abstract metaphysical oneness but as "the original substance of life itself, energy in its most pure and potent form" (p. 93). According to Isabel Robinet's "Later Commen-taries: Textual Polysemy and Syncretistic Interpretations," the panoply of text interpretations falls into roughly three categories—"technical or specialist readings," "philosophical exegeses," and "inner alchemy interpretations," which she then proceeds to divide further into "philological" and "ideological" readings. The role of responsible leadership—for each leader and as part of a leader’s collective actions—is essential to global competitive success (Doh and Stumpf, Handbook on responsible leadership and governance in global business, 2005 ; Maak and Pless, Responsible leadership, 2006a . Failures in leadership have stimulated interest in understanding “responsible leadership” by researchers and practitioners. Research on responsible leadership draws on stakeholder theory, with employees viewed as a primary stakeholder for the responsible organization (Donaldson and Preston, Acad Manag Rev 20(1):65–91, (...) 1995 ; Freeman, Strategic management: a stakeholder approach, 1984 ; Mitchell et al., Acad Manag Rev 22:853–886, 1997 ; Phillips and Freeman, Stakeholder theory and organizational ethics, 2003 . We define and operationalize responsible leadership from the perspective of employees and their views of the actions of their leaders. Drawing on a comprehensive survey of 28 Indian and global organizations operating in India, we report the results from 4,352 employees on the relationship between responsible leadership, their pride in and satisfaction with their organization, and retention 1 year later. Strong associations were found among these variables suggesting that responsible leadership—employee perceptions of the support they receive from managers, the HR practices, and corporate socially responsible actions—may be an overarching construct that connects them to the organization. This article argues that Cicero laid down his imperium in Brundisium in September 47 after Caesar had, in a meeting between the two men, granted Cicero permission to retain his imperium and title of imperator for as long as Cicero wished to do so. Instead of accepting Caesar’s offer, Cicero instead immediately repudiated it, laid down his imperium in the city of Brundisium, and went immediately to Tusculum to begin a second period of political retirement. Caesar’s offer and his return (...) to Italy in the autumn of 47 gave Cicero an excuse to consider expired the SCU of 7 January 49 and, by immediately renouncing his imperium, perform, under the cover of his now-fulfilled obligation to the Pompeians, a calculated personal statement of political independence. When Cicero decided on irrevocable opposition to Antony, the moral and political theorizing about the role of senes (literally, ‘old men/elders’) in the state found in De Senectute provided a convenient and topical framework for synthesizing the invective of the Second Philippic. This essay explores the phenomenon of common sense through a contextual analysis of Hannah Arendt’s political application of Kant’s Critique of Judgment. I begin by tracing the development of Arendt’s thinking on judgment and common sense during the 1950s which led her to turn to the third Critique. I then consider the justification of her move by examining the philosophical context and political applications of the third Critique, arguing that within it Kant made an original and profound discovery: that the (...) phenomenon of common sense contains a hidden faculty that may anchor moral and political judgments. I conclude by arguing that Arendt was on firmer ground than is often thought in adapting Kantian common sense to politics, a fact that may afford new possibilities for the practice of moral and political thought. Shortly after the Vandals took Carthage in 439, the city's Catholic bishop, Quodvultdeus, and a large number of his clergy were said to have been placed “naked and despoiled on broken ships” and put to sea, banished from Africa. By God's mercy, the exiles made their way safely to Naples, where Quodvultdeus quickly came to be regarded as a saint: a fifth-century mosaic from the catacombs of St. Januarius in Capodimonte seems to depict the African bishop, and by the middle (...) of the ninth century his feast day was celebrated in the local liturgical calendar. A similar story could be told of Gaudiosus of Abitina, another fifth-century African bishop who was said to have fled the Vandals and who also achieved sainthood in Campania. The flight of refugees like Quodvultdeus and Gaudiosus from the political turmoil that wracked North Africa between the fifth and the eighth centuries, however, has long been seen as having a far greater significance than the reinvention of exiled African bishops as southern Italian holy men. In late antiquity and the early Middle Ages, the cults of numerous saints who had been martyred in Africa and whose cults had originally developed there spread beyond the shores of the southern Mediterranean to the rest of the Christian world. In seeking to explain the diffusion of these cults, historians have long focused on the movements of refugees—and, above all, those who fled the Vandals' conquest of Africa and their subsequent persecution of the region's Catholic population—as displaced Africans such as Quodvultdeus are thought to have brought the relics of their local saints with them into foreign exile. Modernist philosophy and psychology have pursued a variety of methods and models for understanding the universal inclination of human persons toward moral self-deception. We tend, as the Scriptures reveal and as recent empirical studies have confirmed, to think more highly of ourselves and our personal moral caliber than we ought. Whereas, Freud, Sartre, and others have offered solutions to the “paradox” of self-deception—that is, how one can be both deceiver and deceived—their solutions ultimately fall short in terms of both coherence (...) and explanatory power. From a Christian perspective, secular frameworks are bound to falter because they do not account for humanity’s status as fallen and sinful before a holy God. The gospel of Jesus Christ, on the other hand, offers means not only of understanding, but overcoming, moral self-deception. Historically, no movement of Christian spirituality has been more rigorously skeptical of the human ability to “know thyself” truly than the Puritans. This analysis of Puritan pastoral theology provides a helpful lens through which to view, and undermine, the deceitfulness of the human heart. (shrink)

Empirical evidence suggests that fishes, as a whole, are emotional and possess intelligence comparable to that of mammals. Furthermore, although data are sparse, recent studies suggest that representatives from the two major “fish” taxa—bony fish (e.g., groupers and cleaner wrasses) and cartilaginous fish (e.g., giant mantas)—may possess self-awareness and a theory of mind. We argue that differences in the institutional setting of Europe and the US is the critical factor in understanding policymaking in Europe and the United States, and particularly the influence of nongovernmental organizations (NGOs). To test this relationship between institutional differences, corporate social responsibility (CSR), and NGO activism, we investigate 12 cases involving US and European companies in each of three industries. We conclude that different institutional structures and political legacies in the US and Europe are important factors in explaining (...) the influence of NGOs on business and in the policymaking process, regardless of the timeliness of corporate strategy or NGO influence. Regional market integration in Europe and North America has grown increasingly extensive. This integration has created institutions and structures to guide pancontinental political, economic, and social policies. At the same time, both regions are experiencing pressures of decentralization. These competing trends are transforming relationships between and among business, society, and government. This article compares and contrasts integration in North America and Europe, and discusses the implications of political, economic, and institutional changes in these two regions for business-government relations and the (...) structure and strategic orientation of the corporate public affairs (PA) function. This article reviews recent literature on comparative political economy, business and public policy, and corporate PA, and it presents a conceptual model and research propositions, supported by case illustrations, of how integration and decentralization affect business-government relations and corporate PA in Europe and North America. Dijkerman & de Haan (D&dH) propose a somatosensory perceptual pathway that informs a consciously accessible body image, and an action pathway that provides information to a body schema, which is not consciously accessible. We argue that the body schema may become accessible to consciousness in some circumstances, possibly resulting from cross talk, but that this may be detrimental to skilled movement production.

In 1939, Curry proposed a philosophy of mathematics he called formalism. He made this proposal in two works originally written then, although one of them was not published until 1951. These are the two philosophical works for which Curry is known, and they have left a false impression of his views. In this article, I propose to clarify Curry’s views by referring to some of his later writings on the subject. Evidence is given that implication (and its special case, negation) carry the logical strength of a system of formal logic. This is done by proving normalization and cut elimination for a system based on combinatory logic or λ-calculus with logical constants for and, or, all, and exists, but with none for either implication or negation. The proof is strictly finitary, showing that this system is very weak. The results can be extended to a "classical" version of the system. They can (...) also be extended to a system with a restricted set of rules for implication: the result is a system of intuitionistic higher-order BCK logic with unrestricted comprehension and without restriction on the rules for disjunction elimination and existential elimination. The growing popularization of stakeholder theory among management scholars has offered a useful framework for understanding the multiple and interdependent roles of government and business in an increasingly challenging political and regulatory environment. Despite this trend, attention to the role and responsibility of government to protect citizen rights has been limited. To the two traditional stakeholder theory views of government where the focal organization remains the firm, we propose to add two views by pivoting the government’s place and making it (...) the focal organization. We thus describe governments as serving four roles in the business–government–society nexus. For each role, we analyze typical governmental activities/behaviors, relationships with firms’ stakeholders, as well as the challenges and limits to these roles. We also focus on the central notion of salience amplification, as a means of checks and balances across stakeholders in order to safeguard citizen rights and reveal the greater good. (shrink)

Jonathan P. Eburne explores this question as never before in Outsider Theory, a timely book about outlandish ideas. Eburne brings readers on an adventure in intellectual history that stresses the urgency of taking seriously—especially in (...) an era of fake news—ideas that might otherwise be discarded or regarded as errant, unfashionable, or even unreasonable. Examining the role of such thinking in contemporary intellectual history, Eburne challenges the categorical demarcation of good ideas from flawed, wild, or bad ones, addressing the surprising extent to which speculative inquiry extends beyond the work of professional intellectuals to include that of nonprofessionals as well, whether amateurs, unfashionable observers, or the clinically insane. Considering the work of a variety of such figures—from popular occult writers and gnostics to so-called outsider artists and pseudoscientists—Eburne argues that an understanding of its circulation and recirculation is indispensable to the history of ideas. He devotes close attention to ideas and texts usually omitted from or marginalized within orthodox histories of literary modernism, critical theory, and continental philosophy, yet which have long garnered the critical attention of specialists in religion, science studies, critical race theory, and the history of the occult. Despite the growing interest in understanding the effects of income inequality on economic growth, the influence of entrepreneurship-related institutional constraints on the inequality–growth association remains less understood. Drawing on an institutional constraints perspective in the context of startup entry regulation and credit constraints, we propose that under increasing income inequality, ease of startup or access to credit from the financial sector is positively associated with per capita economic growth. In a sample of 92 countries, robust to alternate specifications, we find (...) support for our hypotheses. Our findings contribute to the debates about the income inequality–growth nexus and imply potential policy interventions in the form of lower startup regulations and domestic credit provision from the financial sector to enhance economic growth under increasing economic inequality.
